Things to consider when requesting spousal maintenance

The divorce process can sometimes involve many disputes and negotiations between spouses. In some cases, they can agree on the terms and each can walk away with what they want, but this isn’t something that happens with every divorce. There may be issues, such as spousal maintenance, causing spouses to become emotional and question if it is really worth the stress. There are a few things they should consider before moving forward with certain requests.

The following are things you will want to consider when requesting alimony from your spouse:

  • Do you really need the support from your spouse after the divorce is finalized?
  • Can your spouse afford to pay alimony?
  • How long do you think you will need this support?

One of the main reasons to consider these things when requesting alimony is because it may save time in court if you know there is a good chance this request will be denied. The judge will look into the same things and more when making a decision, so if a person does not need spousal maintenance, then a judge will recognize this. However, people can still request this assistance because things can go either way and they may be surprised that a judge ruled in their favor.

When making any request during the divorce process, if your spouse does not agree, it will have to be taken up with a judge. Knowing this, you will want to ensure you have a knowledgeable attorney on your side who can help prove to a judge that you need spousal maintenance.
